"@ukhomeoffice: Crimes committed against someone because of their disability, transgender identity, race, religion/belief, or sexual orientation are #HateCrimes and should be reported to the police.

Sex never gets mentioned because the govt would have to get off its arse and properly address violence against women and girls.

Yeah apparently it's down to history. Things were added one-by-one.

I may get the order wrong here, but it goes something like: Hate crime started with race, then sexual orientation got added, then religion, then gender reassignment.

If the thinking is along the lines of protecting minorities, then sex (and age) will never make it onto that list I fear...

Redkeyboard · 13/10/2018 16:19

Also it isn’t transgender identity is it? It’s gender reassignment

The Home Office's description of a hate crime is correct.

If the CPS can prove, beyond reasonable doubt, that a crime was motivated by the features listed in the tweet, then CPS can apply for a harsher sentence.

'Protected characteristics' are a feature of the Equality Act - a civil law that has nothing to do with crime.

It's an easy mistake to make. Sometimes the police and CPS refer to the 'protected characteristics' - but they are not talking about the Equality Act's protected characteristics.

My poorly expressed point was meant to be along the lines that most of the EA protected characteristics are also hate crimes
