In Ireland:

www.con-telegraph.ie/news/roundup/articles/2018/10/03/4162881-judge-to-consider-legal-points-in-mayo-case-involving-transgender-pers

“A District Judge is to consider legal submissions as to whether a transgender person could be properly before a court on charges under the Misuse of Drugs Act, having been charged as a male but was now registered under the Gender Recognition Act of 2015 as a female.”

...“The defence's case is that that person no longer exists and therefore the prosecution should not and could not proceed“

Remember these people who want self ID are harmless.

Grabs popcorn, pulls up chair...

Being trans is literally a get out of jail free card! I really hope this batshit submission doesn’t succeed. What a dangerous precedent it would set.

Totally mad

Lweji · 06/10/2018 08:46

I don't think it will stand, the defense is just covering all options.

Lweji · 06/10/2018 08:47

They'd also have to forgo any inheritance, previous bank accounts, property owned, etc.

Yesterday's thread above.

If a big hairy paedophile can be genuinely be reported in the press as a ‘woman’ then fuck it, anything is possible!

This might start opening eyes here in Ireland. There's very little awareness of trans issues other than a general wish to be kind to someone who is seen as struggling. People honestly look at you as if you have three heads if you try and explain what's happening in the UK at the moment.

Floisme · 06/10/2018 10:19

I imagine it's an Overton window kind of case - not expecting to win this time but laying down a marker. No doubt TELI will be watching closely (if they're not involved already).

arranfan · 06/10/2018 11:40

I'm waiting for someone to adapt this into a contemporary version of Sommersby/Martin Guerre tho' this would be an interesting plot twist.

AngryAttackKittens · 06/10/2018 11:43

Nope, nothing sinister here, no man would ever try to use being trans as a get out of jail free card.

JuliaJaynes9 · 06/10/2018 11:46

They'd also have to forgo any inheritance, previous bank accounts, property owned, etc
Good point!

RedToothBrush · 06/10/2018 11:54

I hope they win.

Then there's an avalanche of criminals who us this as a defence.

It would wake people up a bit when the entire rule of law collapsed.

arranfan · 06/10/2018 12:01

Oh Brave New World - where it will be infeasibly difficult to try people for offences.

Or, if convicted, already serving but read to Self-Id, house them in a appropriate prison estate and therefore be compelled to grant them early release.

BlackAmericanoNoSugar · 06/10/2018 12:16

Unless they have already voluntarily given up all their earnings/savings, sat another driving test in their new name, given up any qualifications, cut all connections with their birth family and friends from school, allowed their house to be repossessed/left social housing, been reinterviewed for their job without consideration of their previous experience etc. then they don't even have the beginning of an argument here.

TrojanWhore · 06/10/2018 12:20

Just as barking as freemen on the land.

Yes, the courts have to consider stuff like this, but there really should be no doubt about the outcome

AngryAttackKittens · 06/10/2018 12:25

There was already a serial killer who tried this, Donna something or other. Murdered prostitutes with the excuse that they were misusing the gift of being female. Anyone know what happened in that case?

Kr1stina · 06/10/2018 12:26

Can I be the first to point out that this literally never happens ?

LinoleumBlownapart · 06/10/2018 12:32

this one?

nicenewdusters · 06/10/2018 12:35

BlackAmericano thats's an excellent point. If the previous identity/life no longer exists after self id, then they cannot claim any of the attributes associated with that identity.

Even if the ruling is not made, can we add this to the thread of things that never happen ? The question has been asked, it's the beginning.

AngryAttackKittens · 06/10/2018 12:35

That's the one! It's great that the "Donna didn't do it so you can't convict me" nonsense didn't work, but the fact that the legal team thought it might is worrying.

Ereshkigal · 06/10/2018 12:38

Anyone know what happened in that case?

Donna was found guilty of serial murder of women over many years but the judge still felt the need to commend Donna for Donna's courage.

SittingAround1 · 06/10/2018 15:37

Well why not? Have we seen it all now or is there more to come....
