"The complaint posted on the Kallman Legal Group website stated that when Cormier entered the locker room to change her clothes she encountered a large, tall man wearing a wig, who looked like a man in men’s clothes. The lawsuit explains that the man’s presence intimidated and frightened her to the point that she did not change her clothes, and instead reported the incident to the staff member.

The legal complaint states that "while Cormier made no judgment as to the lifestyle of the transgender woman in the locker room, who was a visitor of another member, a cursory search of the man under her current name, Carlotta Sklodowska, on her Facebook page revealed serious doubts as to her sincerity." Her Facebook post, listed as Exhibit C of the appeals court brief, showed in part the following:

"I will be a male Slut-in-training on a leash held my mistress, Madame Domino, with a mask made of 2 pair of black panties covering my face and most of my head under a lurid black/red wig, with my ankles, knees and wrists tied together so I can only hobble helplessly in her wake…"

Cormier’s attorneys, the Kallman Legal Group, stated in the brief, "To allow Mr. Sklodowska to have full, unfettered access to the women's locker room, with no inquiry into her sincerity whatsoever, clearly demonstrates that Planet Fitness' policy is actually no more than a vague, politically correct, fantasy." The law firm said in reality the franchisor's policy is reckless in allowing any person full access to what a reasonable person expects to be private facilities designated for females and children".

I don't quite understand the sequence of events, but it looks like Planet Fitness is appealing the decision.

If the SM profile of the person involved has evidence of fetishising as that extract suggests then I think Planet Fitness are possibly creating more of a picture which will highlight why their policy is not appropriate for women. Will be interesting to see how that goes.

This is what we’ve been objecting too. It’s heartening to hear it from lawyers.

It's a long decision but basically it boils down to the gym telling the woman that there were separate locker rooms for women but failing to reveal that "woman" in their eyes included anyone who self-identified as a woman which would have affected her decision to join the gym.

I don't see anything in the judgment that would stop the gym from allowing self-ID though. At best they may end being required to advertise that fact to future customers.

Well that will be great if companies have to advertise the facts.

“We provide changing facilities for woman and for anyone who identifies as such”.
That will make it easier for us all to avoid these places.

Interesting juxtaposition of ‘Mr’ and ‘her’, referring to the same person in a singular sentence!

This law firm do not seem at all cowed by the current climate. Heartening to see.

It does however state clearly and exactly what self ID is: free access for any male with any history and intentions without any kind of screening, into private spaces for women and children.

Also that the proponents of this will always prioritise the personal choice of the male involved over the feelings and concerns of their female users, who can either like it or leave.

And that there is a total blindspot in regard to all the many things wrong with this, and that are likely to go wrong because of this.

That is where the law suits will eventually find targets: not in that places weren't up front about their policy of permitting 'use whatever facility you like' but their absolute failure to follow basic, standard risk assessment in deciding these policies. That's where their accountability for harm will be. However these policies also rely on women simply going along with all this and complying, and that is not a foregone conclusion.

Utterly depressing that this fetish mob have barged their way in under the guise of self ID, Before all this TS like me could just quietly go about our lives but now the sissy slut in training brigade have muscled in we are seen just as guilty by default. I totally understand and see why women are more than concerned by all of this.
