Male armed robber wins $267,500 after claiming gender dysphoria in prison

The Oregon Department of Corrections has settled a lawsuit filed on behalf of a transgender inmate who said she was denied medical care.

The American Civil Liberties Union of Oregon said Michalle Wright had been subjected to cruel and unusual punishment because she was denied hormone treatment and counseling.

The suit said Wright was diagnosed with gender dysphoria and has attempted suicide several times while in custody.

In the settlement announced Tuesday, Wright will receive $167,500 in damages. The state is also giving her hormone treatments, will consider transferring her to a women’s prison and will provide surgery if a medical panel determines it’s necessary.

The policy changes apply to all transgender inmates in Oregon prisons.

Wright was convicted of attempted armed robbery in 2013. Her earliest release date is November 2018.

"On August 8, 2017, ODOC's Transgender and Intersex Committee reviewed Plaintiff's request for a transfer to the Coffee Creek Correctional Facility (CCCF, a women's prison). The TAIC declined the request.

Based on the independent review of the TAIC, ODOC's current plan is to keep Plaintiff at OSCI until the TAIC approves her for a transfer to CCCF.

Plaintiff will be reviewed by the TAIC on November 7, 2017 and every two months thereafter until transferred to CCCF. The TAIC has exclusive authority to determine if and when Plaintiff is transferred; however, that decision will be based on legitimate, documented security and health concerns and not concerns over Plaintiff's biological sex or genitalia"
