Utterly ridiculous and the police give her an excuse - she was on medication!
I am appalled!

Women can be convicted of rape, I'm pretty sure. There was that horrible case some years ago - the woman who was raped by the Kings Cross Canal by a group of teenagers, including a girl who held her down and egged the boys on. She did time for rape.

unhombre · 30/08/2012 23:45

Devora - no, not in the UK. It must involve a penis. She will have been prosecuted for a sexual assault, or a 'conspiracy' , or 'aiding and abetting'. Forget the terminology.

EatsBrainsAndLeaves · 30/08/2012 23:51

Sorry left off the raped by women. Men are raped by other men. But it is rare for men to be raped by women.

Devora · 30/08/2012 23:53

My understanding is that women can be charged with rape, but obviously as an accessory to a man with a penis (though the charge is still 'rape' rather than 'assisting rape'). But yes, if we're forgetting the terminology then obviously it's different.

And now with name changes, I dont know who most of you are any more!

unhombre · 30/08/2012 23:54

Well, I am prepared to pit the law of the land on this issue i.e. Sexual Offences Act 2003 Part 1, against the reporting skills of a DM court reporter, and suggest the woman wasn't convicted of rape. Shock

Ok Smile

LurkingAndLearningLovesCats · 31/08/2012 02:49

Thanks Eats. That does make a LOT of sense for me.

Wouldn't it be great if we were able to have a 'one size fits all' rape law? :( Guess I'm livng in a dream world. Wait...There'd be NO rape in a dream world!!!

LastMangoInParis · 31/08/2012 08:51

Devora and unhombre you are both right (sort of).
A woman could be charged and convicted as an secondary party.
Secondary parties are also participants, so they're not necessarily treated lightly, sentencing can be as heavy as for any other parties to crime.

If a women was a secondary party to a rape then that's how she'd be charged, not for sexual assault unless that was a separate offence.

LurkingAndLearningLovesCats
"there are so many sites where men flash young girls regularly."

Isn't that two different laws tho?
and when minors are concerned a third?

LurkingAndLearningLovesCats · 01/09/2012 00:58

I'm unsure of English law, so I wouldn't know.

Anyway that was just an example to a question Eats answered for me. :)

ItsaTIARA · 02/09/2012 12:10

If you are an accessory to a crime then you will be charged with that crime. The classic example is Derek Bentley, who was hung for murder although Chris Craig pulled the trigger.

Hence if a woman encourages a man to rape somebody then she will be charged with rape (although her sentence will probably be less severe than the actual perpetrator).

Dana1980 · 04/09/2012 02:55

The article didn't even mention the word rape. I have a feeling the tone would be different if the genders were reversed, and I'm not sure a man who raped and used a knife would be shown leniency because he was on medication.

@MisogynistToolMagnet"BTW, women can't rape men. HTH. "

If forcing someone who is non-consenting to have sex with you at knifepoint isn't rape then I don't know what is.

@Zhaghzhagh"But how is it possible for PIV sex if a man is not interested/hasn't got a hard on? "

A man can get an erection during non-consenting sex just like a woman can have an orgasm during non-consenting sex. It doesn't mean the man/woman is enjoying it or gave consent.
