If a teacher is in the process of an occupation health meetings this term etc can school say (in the performance management file) that the informal support plan within the capability will start September?

this is a question for you union as depends on context.

Unfortunately schools can do what ever they like with regards to capability.

Were you aware there PM issues before sickness? Is it a disability or pregnancy related illness? Is it WRS related to performance?

Two scenarios to think about:
if you have been of 4 months with cancer and had previous unblemished record and set return date of September and were told you would be in capability I’m sure questions could be asked.

if you have been of with WRS related to performance related issues - not really surprising.

sorry you are going though this it l is hell and I would resign now and be off sick and look for a new post. And never darken their doorstep again

I’m not sure where you are with the process as you’ve mentioned informal support and capability. If you are well enough to work, it would likely be judged you are well enough for the informal support and /or capability processes to continue. Any advice from OH should be added to your support plan.

If they have actually said this to you like this, it could be, yes. Are you in a union? You really need to get them involved. What do you want to happen? Have you already been through a period of around 6 weeks of informal support? Has there been improvement on your plan if so?
