Fixed term contract/ holiday pay

If a teacher is on a fixed term contract, am I right in thinking their contact would run to the end of the holiday period after the term they have worked? So, if working the summer term, they would be paid until 31st August?

It should do, yes, but there's nothing to stop a school from trying it on & hoping you don't notice. If you don't get paid for the holiday, then your term-time pay should be higher as it would include an element of holiday pay.

Maternity leave posts are different; the post holder can quite legally return on the last day of term and you then wouldn't get paid over the holidays.

Thanks for your reply. It's not technically a mat cover at present but there's been a lot of shuffling about and there are staff off on mat leave. Do you know, in the case that temporary teacher would have worked the whole academic year to that point, whether they would be entitled to the holiday pay?

Teachers are paid for 195 working days each year. For our convenience, this is divided into twelve monthly payments. Your employer should either be paying you 1/195 of your annual salary for every day you work, or dividing your salary into equal monthly payments. They can't just ignore your entitlement to holiday pay.

If you're not in a union, I would suggest joining one ASAP.

Thank you. This is helpful and what I thought (hoped!) but I wanted to be sure. I have asked the HT when my contract will run to and was told it could be either August or the end of term - they don't know. I'm on a fixed term contract which is being extend by a further term from Easter, which is why I have asked. I have been at the school for over a year already.

I want to make sure my pay for the year is my full salary, either with being paid in the holidays or being paid at a higher rate for the summer term and feel more confident I am correct in asking for this now - thanks again!

I am in a union and have contacted my branch rep as well as posting on here.

I'm doing a job share for Spring and Summer terms - my contract ends 31st August.
