Maternity Leave

Hello! As a 1-1 / TA, if I went on maternity leave- could I come back on December 17th (the last day of term) and get paid over the christmas holidays? I have been told I need to come back on December 1st if i wanted pay over Christmas. I know teachers come back the last day before Summer holidays etc... to get paid over summer. I am just unsure who to ask.

TA pay is pro-rata, not at all like a teacher's salary, so I can see where the December 1st idea would come from (i.e. you'd have to be working that whole month to get the whole month pro rata salary). Best to check with your LA or Union though, as it's all variable!
