Duke of Sussex & Others vs ANL: thread 4

1000 replies

bluegreygreen · 12/05/2026 17:19

This is the fourth thread discussing the case Prince Harry (and 6 others) brought against the Daily Mail (Associated Newspapers Limited; ANL) for alleged unlawful information gathering (UIG).

The claimants are: Prince Harry (PH); Doreen Lawrence (DL); Liz Hurley (EH/LH); Elton John (EJ); David Furnish (DF); Simon Hughes (SH); Sadie Frost (SF).
They are represented by David Sherborne (DS).
The defendant (ANL) is represented by Anthony White (AMW).

The threads to date have been thorough discussions of the evidence (so far as we were able to obtain it), with posters giving links and explaining their views. We have mostly kept things civil by avoiding partisan discussions on specific Royal Family members, and trying not to be derailed from the topic of court proceedings.
The case has concluded and we are now awaiting the judgement from Judge Nicklin.

We have also included (when things slowed with the title case) other cases or discussions with a specific theme of free speech/press freedom, particularly when related to those with money or power preventing others from speaking.

One current ongoing case is that involving @GwendolineFairfax8 - some details towards the end of thread 3.
The case is in court this week and is likely to be reported on at the end of the week.

Notice the phrase "questions about the conduct of certain elements of the legal profession". I suspect consequences for some of the lawyers involved will be seen.

Can we expect a statement from the luxuriously maned lawyer?

MrsLeonFarrell · 07/07/2026 16:52

Not for me

He was quick to pontificate in previous cases so I hope so

No, @BasiliskStare , it’s happened a few times now when I try to archive, I think some media have now found a way to block archiving

BasiliskStare · 07/07/2026 16:58

OK sorry - I did exactly the same as any other archiving I've done so I think you might be right @Thedom. @MrsLeonFarrell - I'm afraid that was my best shot !

You mean Sherborne, MrsLF?

At least in some previous cases there were factors - however small - for him to cling onto to pretend some sort of vindication, but with the total wipeout this one's been it would be entertaining to see him try

And here's an awful thought ... can any of them appeal?? Hmm

From what I've read, the defeat is so comprehensive that it's highly unlikely an appeal would be granted, even if any of the claimants were so minded.

Recklessismymiddlename · 07/07/2026 17:07

Im sure they are looking into it. I’d be hugely surprised if they aren’t. Need the legal beagles to look at it carefully, for us, to see how watertight the judgement is.

ThatCyanCat · 07/07/2026 17:07

I'm reading £50m in costs? Will that be split equally among them?

Just seen on Chris Ship's X feed that Sherbourne turned up at the Invictus event Harry's at – imagine he was summoned to explain what went wrong. I wonder if they are actually contemplating appealing the verdict?

Yes. He seems to have been actively looking for people to join the case and he must have known the evidence was poor.

I don’t understand the Harry hatred on here. If one was to apply an empathic lens it doesn’t take a genius to work out why he has wanted to take this to court. He is at the end of the day a Dad who has suffered poor mental health in the past. Be kind.

Thanks for this.
Best laugh I have had for ages.

MauveLibrary · 07/07/2026 17:13

I thought appeal would only be possible if there is a technical point of law in question. That doesnt seem to be the case here where the judge has ruled that the claims are dismissed due to lack of evidence. Appeals are not normally just because claimants dont like the fact that they have lost.

Thedom · 07/07/2026 17:14

Video of Sherborne arriving to meet Harry at the Invictus event, his hair is a right mess 😂😂

I can only hope you're right, IcedPurple, but with Harry's disinclination to accept the word no and lawyers' hunger for fees nothing would surprise me

It’s behind a paywall, and it won’t allow me archive.

how do I archive?

Thedom · 07/07/2026 17:32

https://archive.ph

normally you just copy the URL and it unblocks the paywall,

Yes, I've had problems recently, I think there are moves to put a stop to the free access that archiving facilitates. ☹️

What is going on with the internet archive?

AI Overview

The Internet Archive is currently navigating major hurdles, including mass publisher blocks on the Wayback Machine, existential copyright lawsuits over digital book lending, and the fallout from severe data breaches and cyberattacks. Wikipedia +2

The situation involves several ongoing, high-profile challenges:

  1. Mass Blocking by Major Publishers
Dozens of major news organizations and platforms—including The New York Times, The Guardian, and Reddit—are blocking the archive's web crawlers. While publishers state their measures are intended to prevent AI companies from scraping intellectual property without permission, the collateral damage is that the Wayback Machine is being barred from saving a vast portion of modern digital history. Electronic Frontier Foundation +2
  1. Legal Battles Over Copyright
The archive has been embroiled in severe legal fights with major publishers . Most notably, in the Hachette v. Internet Archive lawsuit, a court ruling forced the nonprofit to pull hundreds of thousands of digital books out of its lending system. Publishers argued that the archive's "Controlled Digital Lending" program, which let multiple patrons check out digitized copies of physical books they owned, constituted copyright infringement.
