Who's dog is in the wrong?

My dog has a puncture mark just near her eye which bled a lot to start with but ok now. it was caused by next doors dog.

Basically if i let my dog into the garden and next doors dog is out it runs up to the wall where next doors dog can literally half hang over our wall and they have a good go at each other. Usually just noise.

I thought until today that they couldn't reach each other but their dog reached right over and when my dog jumped up and bit her face.

Its hard to stop it as I can't see into their garden ( to only let my dog out when theirs isn't) so I rely on hearing it, which doesn't always work.

It's really peeing me off as I think my dog is just trying to 'protect' her property. We only have a small garden so can't really start fencing it to create boundaries etc and really don't want to.

Should we be asking them to pay to fence above the wall on their side as its their dog reaching over? Or should we just shell out and cover the cost ourselves?

Could you speak to them and see if they would be willing to pay half each? If not then I would just shell out to keep my dog safe.

Who is responsible for the wall? It must belong to either you or them. If it's yours then I would do like libertyflip suggests and just extend the height of it somehow. However, if their dog is leaning over into your garden and it's their wall, I think you should ask them to fix it. (Also if there are any vet costs associated with the bite, you could ask them to pay).

Could you stick a bit of trellis on top of the wall? just a cheap barrier which would be enough to stop physical contact? If it's their wall find a way of having it held up against it without damaging it?

You must find out which of you owns the wall. If you, then you can do what you want so long as it is not too high. And the neighbour is not allowed to touch it, so theoretically, their dog is not allowed to hang over it into your air space anyway, or you.

Why don't you both just get together and put something there to keep your dogS safe? I think both OWNERS are equally responsible.

Their dog is reaching down - but your dog is jumping up, there's not really a right or wrong there.

Both dogs are protecting their own property neither is wrong and neither is right. Trellis put up after discussion with your neighbour should stop the problem.

Thanks all, yes, we ended up putting up a 'border fence' today after speaking to them yesterday. Not sure who's border wall it is.

Just have to train my dog now to stop barking at the next doors dog!

Now that is a tall order.
We had a dog and a cat next door. Cat sat on the fence looking all superior as dog kept barking, she knowing dog couldn't reach her.
