maybe he was too poorly still when they filmed this (they're usually about 6-8 weeks behind - it was snowing last week in the square) it takes aaages to get over pneumonia when it was as serious as he had it.

I think Billy has been arrested because after the murder Phil,Ben and Jay burned Jay's hoodie from the stag do as it had Hev's blood on it. Then the charred remains were found and the police wanted everyone at the stag do to provide their hoodie to rule them out of the investigation.
Jay/Ben/Phil panicked knowing they would get found out and nicked Billy's hoodie and passed it off as Jays.
