Tenancy contract

Hi, me and my partner have split up, I’m not living single with my 3 children, my tenancy is due to end 1st August, my landlord asked my ex to stay on the contract until it ends which he agreed. Now she’s saying she’s not taking him off the contract and it’s going to be a rolling contract? Where do I stand as I’m not renewing the tenancy and it’s due to end? Can she do this?

You will be able to end your tenancy by giving 2 months notice.

Under the new legislation due to come in all tenancies will be whats called periodic and will proceed from month to month on a rolling basis. So its not worth the LL issuing a new contract now. Once the new law comes into being (probably late this year) your LL will only be able to evict you for certain specific reasons - for example rent arrears. serious anti social behaviour or if she wants to sell the property or move in.
