Has anyone opened a 'case' with eBay?

I bought a Janet Collin handbag off eBay, and the seller described it as 'barely used'. It arrived today and there are clear signs of wear (the clip on the mirror which is attached by a buckled strap is broken, the metal rivets which are quite big also show signs of wear). I've contacted the seller to request a £10 refund (the bag cost £40). Has anyone had any success with getting cases such as this resolved? TIA

Id give the seller a chance to respond first. I hate it when buyers email me asking for something then open a case an hour later. Im not always sat at my computer I have other things to do.

More than likely its been an oversight on her part and she should reply if shes a good seller saying sorry and agreeing to the refund.

If not though then open a not as described case and you can say how you want the seller to reply. So in this case you would ask for a £10 refund. Maybe give her at least a full day to reply and then open a case.

Yes, for something that was like your situation where the item was not as described. I had contacted the seller and they hadn't bothered to respond. It was easy and straightforward and I got my money back. The seller didn't want the item back.

Iswallowedawatermelon · 04/06/2014 21:53

Yes I did as the seller wasn't communicating at all. Was very easy and got my money back :)

Saurus72 · 04/06/2014 22:18

Thanks - yes, I'm definitely planning to give the seller chance to respond. Ebay say I need to give her until June 12th which seems reasonable.

I very rarely buy from ebay - I think it's interesting they don't allow you to write negative or even neutral feedback without contacting the seller first. I guess it's fair, but still interesting!

when you return it don't rely on signed for with RM - send courier like Hermes or Collect plus - cheaper too.

Saurus72 · 04/06/2014 22:33

The seller says she doesn't accept returns, so I'm not sure what will happen. Hopefully she will just agree to the partial refund.

If it were me and she says she doesn't accept returns, now is the time to open a case. Let eBay decide.

CeeceeBloomingdale · 04/06/2014 22:43

I'm in the middle of one. A case was opened automatically when I ticked the not as described option. Almost identical situation too, 'new' handbag was damaged. I photographed it and asked for either a reduction or a refund. She wouldn't reduce the cost so I've returned it (I contacted ebay for advice and they send me a postage paid collect plus label as they saw the pictures and the postage was very high compared to the item price). Now I'm waiting for the refund (which should be initial postage plus item cost according to ebay rules). I believe an alternative is to open a paypal dispute.

Butterflyspring · 04/06/2014 22:43

the seller has to accept a return - they won't have a choice if you open a case. They prob won't give a partial refund though - and ebay will never enforce that. Just open the case and return for a refund. And leave appropriate feedback and stars too.

Saurus72 · 04/06/2014 22:50

Ceecee yes, my case was opened by ebay when I tried to give neutral (not negative) feedback about the seller. Good to know about ebay sending out postage paid sticker thanks.
Butterfly I will wait until 12 June to see if she responds, then will contact ebay.

have you opened a case already? Did you click the button not as described? If so it is done already and you have to wait 8 days to escalate.

Saurus72 · 05/06/2014 06:41

The seller has given me the partial refund as requested, so the case is now closed!

Wish mine was, they've offered a part refund after I've returned it!

Saurus72 · 05/06/2014 13:23

How can they possibly give you a part refund only if you have returned it? That sounds a bit suspect to me...Hmm

OP posts:
Butterflyspring · 05/06/2014 14:05

she hasn't returned it - she asked for a partial refund and to keep the bag.

And Ceecee if you return it you are entitled to a full refund of everything you have paid - not just part of the money!

CeeceeBloomingdale · 05/06/2014 14:20

Yes, I've declined the part refund of no bag and am insisting on full value back, she can get ebay involved further if she likes, I doubt they're going to agree with her!

Upsetwithfriend · 05/06/2014 14:38

And Ceecee if you return it you are entitled to a full refund of everything you have paid - not just part of the money!

You are only entitled to a full refund of your original payment (i.e delivery and purchase price).

Ebay cannot force a seller to refund the return postage, so you can still end up out of pocket for that.

Butterflyspring · 05/06/2014 15:13

Upset - actually if they tell ebay they don't want to pay to return ebay will either give a free prepaid return label or will give a no fault refund without the need for a return.

nowhere did I say the seller would be forced to pay return postage costs - but a good seller will if an item is not as described.

CeeceeBloomingdale · 05/06/2014 16:41

Upset - ebay gave me a label to return it but the seller only wants to refund he price of the item, not the original postage which ebay have already told me they have to refund as well. The seller is really making this as difficult as possible

Butterflyspring · 05/06/2014 17:12

I hope you neg and leave low stars - seller is obstructive & above all, wrong.

CeeceeBloomingdale · 05/06/2014 17:37

Yep, as soon as it's sorted I'm leaving the most stinking feedback!

plentyofshoes · 05/06/2014 19:13

Everytime I have had a hanbag off ebay it goes back. I had a lovely one from jigsaw which had a fag burn in it!
