Sorry if this has been asked before, I've looked on the council website and citizen's advice but it's still unclear.

My partner has two children from his previous marriage who come to us 50% of the time. His ex-wife claims the child benefits for them.

If we were to have a joint child, would I be entitled to claim the full rate of £21.15 per week as it is my first child, or the lower rate of £14 as it is his third child?

We are unmarried but live together, which is likely to stay the same.

You claim as the mother in your name as your first child

As neither of you receive child benefit either of you can claim as having a first child.

For benefits like child benefit even though you aren't married because you live as a couple both your incomes count.
