Adopt or parental rights?

Me and Dh have been together 7 years. My Dc haven’t seen their dad in 3. He pays nothing and wants nothing to do with them. They are 13 and 11 and have decided they don’t want to see him. He was very abusive and they saw it all.

My dh wants to have parental rights because if something happened to me I would feel sick that xh would have a say in the Dc.

What’s the best way of doing this? Xh is happy to sign anything that means he doesn’t haven’t to be a dad.

You’ll need to see a family law solicitor about your ex relinquishing parental responsibility and your DH attaining it (or adopting the children).

Just to say...we didn't see our bio Dad from a very young age. Mum and Step Dad (who've now been together just shy of 30 years) never chased this. Now our worry is if DM dies then we have no 'rights' over DSD care etc. We are his only children and the HCPs won't give us info etc when he's in hospital. I'd give it a bit longer but get it done by the time they turn 18.

Can your stepdad give you and your siblings power of attorney, @BigBrows? My mum and my stepdad did this alongside making wills, so my sister and I can make decisions on their behalf if they ever need us to.

If your EXH isn’t going to contest it then it’s a pretty straightforward process to apply for parental rights. Just contact a local family law solicitor and it will all be done in a few months.

Thank you! Is there no way to do it without a solicitor? I will do though, thank you x

No you can’t have parental rights granted unless you go to court
