Please I need help, our two children spend 149 nights in a year with me. Am I, eligible to claim WTC? to help with child care cost. I work 37 hrs a week.

It depends on whether the other parent claims tax credits, only one claim can be processed for the children.

In my case I claim, which means my ex is unable to.

I believe it is possible for you to claim for 1 and the other parent claim for the other if you both agree to it.

Thank you, SweetEnough and LilaBard. I spend over £300 on child care cost; ex partner claims tax credits and will never agree for me to claim for one child...

Sorry about that, co-parenting can be a bitch! I chose to claim because I work part-time, don't ask for maintenance, have my 2 dd's 70%, pay for everything and I do all child care etc, I work around his days off. Yet he feels hard done by, I can't win.

I don't think you're eligible for WTC, if your ex claims it already. Have you looked at whether you're entitled to any of the free hours at the nursery or child minder who looks after your children.
