CSA arrears - who's liable?

This struck me when I was reading another thread - are CSA arrears considered to be a "family debt"?

Is a spouse liable to pay arrears if their DP dies owing their ex money via the CSA and is it included as part of the financial disclosure/settlement in divorce?

I assume it is treated like any other personal debt, the responsibility if the Nrp whilst he/she is alive and not the spouse and to be taken out of their estate in death. The CSA would have a claim on the Nrp estate if he/she were to die, although I'm not sure how that would be calculated if a nil assessment had been made before death.

If my partner was in arrears with the CSA and died then afraid his ex would be getting a bit fat zero off me, just as it stands whilst he's alive. I'm not liable.

SoWhat - she might not get anything off you, but would have a claim on your partner's estate. In fact if you're not married and you don't have wills then you wouldn't have any claim on his estate.

I know it's all hypothetical, but he doesn't own our house anyway as we rent and have no intention on getting a mortgage, basically because we can't get on the property ladder.

Doesn't savings, life insurance and pensions class as the estate too though?

Eeek. He has none of those either. Luckily he isn't in arrears and never will be.
