Should we ask to end DS's EHCP?

DS1 has ADHD and a long history of struggles at school including exclusions, missed learning etc. We finally got him an EHCP in the February of year 10, mainly to stop him getting excluded to allow him to do his GCSEs. He didn't really need any support other than flexibility as often late, disorganised etc so would rack up a lot of behaviour points. He got 9 GCSEs and did well enough to go onto A-levels although he wasn't overly keen. He had an offer from the sixth form of his previous school but decided to move onto a different sixth form with his best friend. The EHCP was reviewed at that point and the new school named in his plan. Whilst he was there, DS received no support and the plan was not reviewed either by the school or EHCP and basically forgotten about until June/July this year after DS finished his A-levels. We knew he would need to resit at least one of his A-levels as he missed one of the exams so I started applying for colleges where he can do A-levels in one year. I reached out to our LA to ask what we should do with the EHCP and they said (after a delay of about a month with me chasing) if he wanted to go onto one of these colleges then they would need to consult with them. They then started the consultation process but it was the summer holidays so took ages and then both the state colleges came back saying they couldn't meet his needs. Absolutely no idea why as he doesn't have any specific needs (other than poor attendance, lack of engagement etc although that he improved over the last few months). The LA agreed and named one of the colleges anyway but they have still not offered DS a place. As term had started and we weren't getting anyway, we enrolled DS in an independent college where he is now studying a one year intensive A-level in a subject he's interested in. The college did not ask us if he had an EHCP and we did not mention it as it didn't seem relevant as we were paying for the place. However, the SENCO then called me yesterday said that DS's EHCP may be an "issue". No idea why but very angry and upset as it makes not one bit of difference. So my question is, is there any point in DS having an EHCP? It has served no purpose and, if anything, seems to allow colleges to refuse to take him without reason. If I want it to cease, how long does it take? Can I just request the LA ends it asap? Is there any downside to ending it now?

Just to add, both the school and sixth form he were at were mainstream state schools.

what does poor attendance and lack of engagement look like in reality?

I thought they had refused him coming back hence your “worth appealing” thread? Did they accept him post your appeal then? But you declined?

I think you're confused? Not the same person.

Yes, please do leave this thread as you clearly have nothing helpful to add. How strange that your first reaction on a thread about kids with additional needs is to track back through all my previous threads. Too much time on your hands perhaps?

Have you considered, just possibly, that I have more than one son and this post is about a different son? If you had actually read the thread you would see that the person I am asking about has FINISHED his A-levels, not starting them. If you're going to a detective on Mumsnet and haul people over the coles for past threads then at least read them. Got you there haven't I?

No, I absolutely wouldn’t request the EHCP is ceased. What you need is a proper review and the EHCP amending. It sounds dreadful and needs improving. Besides, the LA can only legally cease to maintain if they are no longer responsible for DS or it is no longer necessary (in the legal sense) to maintain. They don’t seem to apply in your situation.

The LA agreed and named one of the colleges anyway but they have still not offered DS a place.

If the college is named, they must admit. You didn’t need to wait until the college offered a place. This is assuming the college is not an independent college, in which case the college shouldn’t have been named if they don’t agree.

If you are making your own arrangements, having an EHCP doesn’t mean DS can’t go to the current independent college. If you wanted them named in the EHCP, that would be different because the college would need to agree to be named. Is the college worried you are going to try to have them named and therefore they would need to delivered the provision in the EHCP?

He didn't really need any support other than flexibility as often late, disorganised etc so would rack up a lot of behaviour points.

Your post indicates he very much did/does need further support.
