Can someone remind me is it 8 weeks frm when proposed statement to final statement? and can they flout this by saying 8 working weeks ie 64 working days.

Just need to clarify am trying force the lea to clarify a ot issues

Yes a Final Statement has to be issued within 8 weeks - there are few exceptions but having looked at them in the SENCOP it would be things like:

if you hadn't replied within the 15 day time limit/been out of the area for 4 weeks within the 8 week period/
a meeting has already been held with the LA but the parent requests another to include someone else/
the LA have written to the Secretary of State for the child to be educated an an independent school not authorised by him (assume him = LA) and no such consent has been received by LA within 2 weeks of the request.

The final statement doesn't have to have been agreed by the parent though. My LEA are issuing DS1's early even though they haven't included the SALT I requested because I need to get a letter of confirmation that SALT are o.k with termly visits. So the LEA know I won't accept it but wanted to stop the clock-ticking for themselves!

Ty lea won't agree to Ot in statement till he's been assess by Ot as needing it.Ot won't get involved till after ds seen community paed even though we already have dx and ds had Ot input in last statement .and the speech unit won't take less got Ot involved so am hoping since ds been awared place at panel and everyone agrees unit is the right place that Lea might actually do something

Ds community paed is the 2nd June final statement
is the 5th June

hmm it may possibly fall under the exception when another meetign with another person has been requested they can delay but I'm not expert. Worth asking IPSEA/SOS SEN?

ooh I think our final statement has just dropped through the letterbox

ty ot meeting not been requested yet im happy with salt and school so they can issue final and will just challenge them over ot

not challenging it yet as final not issued but am hoping as Lea sugegsted unit as only suitable place for ds and unit saying no ot no place .Lea will back down and give it.

Am hoping it be helped by fact that SS ot are in process of supplying toilet aids , bath hoist and seating so its not like theres no proof of his needs because we all know ss love to give equipment that you dont have to fight tooth and nail for

Hope you can OT added without too much bother. Post alas was not the statement but 2 chequebooks. Should have realised when they bounced back up . Probably means I will get the statement tomorrow. LEA said they were 99% sure they had included all my amendments (bar SALT) but had changed my wording so it gave "greater flexibility" for my DS1. Think that's LEA speak for keeping it as woolly as possible but shall reserve judgement til I see it.
