yes i was told today to go or a caf ds school says he as no problems at school and maybe he needs friends out of school and he will grow out of his aspergers and this was the senco teacher . he as got a dx and we know most of his problems are social, but he as problems with handwriting, toilets needs, and they not helping him with time tables, like dinner time changes and so on. i think i will appeal

dare you to email whoever said that, ask them to confirm it in writing and refer to appropriate sources of info

and copy email to LEA- start confirming every single word in writing or print, and be a bastard

and of course appeal. They expect it.

thank you i will appeal, i am going to start writing it all down, i have told his pead ss and even ed pys thats what they said , we have been told we can not go into school until they seek advice from some one and our school nurse phoned us yesterday to say we have a meeting regarding his toilet needs next week, she was told his teachers was upset that ss went in with out us telling then, but we did tell her and she said oh am not going to be in ha ha, but she never passed on the message to relive teachers and now we getting called lairs.

Yes - Trace. You're starting to experience how school deal with things they don't like i.e. by calling parents liars and denying things they said or claiming they were unaware of things you explicitly told them.

It's quite shcoking isn''t it when you experience behaviour like that from people who you previously trusted.

Don't take it personally - it's widespread. But do keep a note of every dealing you have with them so you can refer to it later.

thanks WetAugust it as upset me, `i know we need to appeal but they really do make it all so hard and i keeping thinking what if its in our heads that ds needs help!

Trace2, you should appeal. Apparently they send a standard response in the hope that most will not appeal.

When my SA was refused i

  1. Wrote to the LA requesting a copy of my child's school file and other info, such as SEN budget etc.
  1. Prepared my tribunal submission.
  1. Wrote to the LA again in response to their reply.

LA recommended CAF assessment to identify underlying causes of anxieties. My arguement is 'The LA have recommended that the school arrange a CAF (common Assessment Framework). I feel a CAF assessment is not necessary to identify the underlying reasons of his anxieties. ds has had enough professional input already and enough evidence has been provided to show that a statement is necessary. If evidence is missing it would be more appropriately obtained via a Statutory Assessment than a CAF assessment. Whatever the outcome of a CAF decision the LA have to be prepared for their contribution to the CAF decision.

The test for a statement in law is whether the school can provide for the child from it's own resources with the help of the LEA R v Secretary of State of Education ex parte E FLR 377 Court of Appeal 1989.

The LA should be considering whether a statement is necessary under the Education Act 1996, sections 323 and 324, not according to the availability of information.

So write to the LA and find out why they feel a CAF assessment is necessary and take it from there.

thank you so new to this and finding it very hard taking it all in. my dd is hoping to get a statement for different reasons to ds she as had assessments already but portage sorted it all out and we been told by ed phy and medical she should get 4 or 5 which it top. with ds because he already in school well its a nightmare.

Claw3 they say in our area that a CAF has to be done to access services. I can't see that this can be right. Services should be based on need not intrusive blardy forms.
