Naming a school part 4

Ds orginal statement named his previous ms school but at review I asked for this to be redone to name speech unit

But Essex are saying no to ds having place at unitwere in herts but only 4 miles from unit I wanted as his needs are to severe not a short term problem it's acknowledged would need help right through school life plus extra support for his pd

Herts are now aware that since ds not had school placement since January that there breaking law sossen sent solictors letter reminding them of this

there now talking about ds in ms as temporary placement I'm totaly against this .there pushing me to name ms in part 4 but have told them will not my worry is that if I agree to this that he be there and lea of hook find more suitable placement

But I have found of own back sn nursery that will take him twice week for 5 hrs at time provide 1 to 1 and inhouse phydio salt etc while lea faff around can I push them to provide transport

Ds not 5 to July so though was in ft school and step back but bears having nothing
So can I refuse p

"4:45 "LEAs should note that parents of children under five and over two may express a
preference for a maintained school to be named in their child?s statement. The LEA must
name the school the parents name so long as it meets the criteria set out in Schedule 27
of the Education Act 1996. (See 8:58). A key issue is likely to be whether a school is
suitable for the child?s age. The parents may also make representations in favour of an
independent, private or voluntary early education setting for their child. If the LEA
considers such provision appropriate, it is entitled to specify this in the statement and if
it does, must fund the provision. There is, however, no point in doing this for settings
outside the maintained sector unless the setting agrees as the LEA cannot require an"

8:62 "Where an LEA proposes to issue a statement or amend part 4 of an existing statement
they must name the maintained school ? mainstream or special ? that is preferred by the
parents, providing that:
the school is suitable for the child?s age, ability and aptitude and the special
educational needs set out in part 2 of the statement
the child?s attendance is not incompatible with the efficient education of other children
in the school, and
the placement is an efficient use of the LEA?s resources."

If it is suitable, will take him, etc. I can't see why not.

The nursery is suitable it's run by mencap

the ms they want me to name on their words as temporay measures like I would fall for that went met them and while there hearts ,they they admit they never had dc with sn not got a clue no adaptions done so ds would struggle for access on his pd alone

ok think going to push see if lea help with transport
