hi flyingmum I have read all your story to date.We are also looking at independent /specialist provision.
Our son is in yr 6 .
I was surprised that LEA gave in just before your tribunal-they obviously felt you had such a strong case.Our son has severe language impairement(just diagnosed-been described in 20 hrs statement as language difficulties since yr 1)He has low self esteem,very low attainment -levels 2c.He will not be entered for SATs. He will not be able to cope in m/s .SLT will be 5 blocks a year instead of 21.Plus all the other emotional/physical changes of secondary .He has had 1-1 for 5 years and is still at these levels ,will LEA still say he is "progressing at his own rate "-I HATE that terminology!To us it is obvious we will win!??! His needs are not and will not be met. Any thoughts x

I think the key is 'progress' not attainment. So you need to look at the pattern of attainment.

Hi, not sure what stage of statementing/appeal you're at. Have you got a secondary placement named yet on an amended statement? As it's a transition year, the LA must name the school your child will attend from September, by Feb 15, this is in the COP. As soon as you receive the final statement, you can appeal. It can take 5 months to get a tribunal date and they don't sit during August so it's best to submit the papers asap.
