DLA Reconsideration

Dd's dla renewal decision came back a few weeks ago, dd was on higher rate care and mobility, they decided she was not entitled to anything on the renewal even though i had sent them exactly the same information as the first time and a lot more as dd has got worse lately.

Anyway i asked for a reconsidersation and sent in more information, they have now sent me a letter saying they have written to dd's school for more information. I am outraged, her school is crap about knowing about dd's condition, they dont follow the advice dd's physio gave them and half the staff dont know about dd's condition. They have only just written to them and they are on school holidays, i will recieve no dla payments in january and will be short on money, we are desperately trying to save up for a specialist bed for dd and without the dla we just cant do it, and i knoe the school will turn round and say there is nothing wrong with her because they are useless idiots.

Can i ring them up and say i dont want them to include a report from the school?

No. But you can supplement their information with reports from actual specialists.

I don't get how the school can say there's no problem if she has ASD and CP (did a search cos couldn't remember what DD's SN were) but if they don't find her SN a problem then DLA might say that her needs can't be that bad so you need professionals' reports as ammo.

They are muppets. J has gone from MRC and LRM to nothing to MRC and LRM again to HRC and LRM and finally high rate for both after an appeal, all in the course of a year and a bit, after a renewal. There seems to be no rhyme or reason at times.

Just stick to your guns, do the appeal and look forward to a backpayment. Get copies of all reports done on DD. Does she have a Statement? Because the tribunal took a lot of notice of J's statement because of course it's a legal document so they know that all of the info is verified or the LEA wouldn't have allowed it to go in there.

Thank you GiveMeMore, reports from physio and paed have been submitted, they have written almost exactly what i have written.
It is just not what we need at this time of year. Dd doesn't have a statement at school, we felt she didn't need one as her phsio is a regular visitor to her school so could check on progress and make sure teachers are following her physio guidlines, although dd's teacher has barely been in since she started year1 and i have seen countless supply teachers who have no idea about dd so she is coming out of school in pain because there is no-one there who knows to make sure she does her excercises sits properly ect.

Why does the DWP make you jump through hoops for something like this, dd is entitled to it as far as doctors ect are concerned but the pen pushers at the DWP who are not medically trained think otherwise.

I would have thought that proving mobility would be easy enough if movement actually causes pain.And high rate care only really comes down to if she needs full supervision all day and watching over if up at night, and night needs must be present for high rate.

I think the DWP just enjoy the hoop-jumping as it's not them that has to do it! Really really frustrating I know.

my ds4 got refused mobility after school reports, ridiculous considering up until last yr he was on high rate, didnt expect high rate but to go to nothing seems madness. i honestly think it depends on what mood the powers that be are in on that day. i would go with sending loads of other stuff in aswell, if the school are that useless then they cant help, mine are normally good and it still didnt help.
