Dols

My son is 16 soon and will lack capacity for more important decisions. Does anyone know how dols applies for a 16 year old in this situation who needs supervision and cannot go out alone due to their own safety?
Thanks

Deprivation of Liberty Safeguards (DoLS) doesn’t apply to 16 year olds. It only applies to those 18+ in certain settings.

The Court of Protection can Grant a Deprivation of Liberty Order (sometimes called DOLO) at 16 if necessary, though.

Thanks for the info. I suppose what I need to know is in that situation do I need to contact social services prior to 18? He currently doesnt have a social worker.

DoLS may still not apply at 18. It only applies in some settings such as hospitals and care homes. A DOLO covers those 18+ and e.g. living at home.

If DS has needs significant enough that you are questioning whether DoLS/DOLO is required, then a social care assessment would be a good idea, IMO.

Thank you, much appreciated.
