DLA - Questions with appealing and COC

Hi!

My DS who turns 5 in 2.5 months has currently changed from MRC to HRC after a MR. The DM said he wasn't entitled to HRM - which I have lodged an appeal for as I believe we have enough evidence to support this. As he is not yet 5, they couldn't look at LRM either. My question is as I have an appeal outstanding, can I also do a COC when he turns 5 alongside the appeal?

Also, with regards to the appeal process - when it says the DWP have until x date to respond - what happens here? Is this for DWP to review my appeal?

DWP’s response is to say if they will be opposing the appeal or not. Be aware they don’t always stick to the deadline.

You can do a COC. However, this can sometimes complicate things because Tribunals will often then only deal with the period of time between the decision under appeal and when a new decision following COC is made.
