Separated parents - Childs DLA Question

Hello

Have been on these forums reading for some time.
Finally looking for some advice so have now joined - 1st post!

I will try & make this simple to read (mainly for me)

Me & partner separated end of last year (not married)

We have a young child who receives DLA

Ex-partner receives this payment

Our child lives with me majority of each month (60/40)

Ex-partner will not share the DLA payment - that is for the benefit & support of our child

Have tried to have this discussion a few times & always ends up with ex-partner not budging.

Is the next thing to do - Mediation before a court order?

Spoke to DWP & DLA they cannot do anything at moment.

DWP aren’t telling you the whole truth. They do have the power to rule on a counter claim and decide who should claim on behalf of the child. However, challenging this is often harder if the funds aren’t being misused (not sharing the DLA doesn’t automatically mean it is being misused). There is no provision in law for splitting DLA 50/50 or 60/40 etc. Although, I do a few who have managed to secure an order as part of wider family court proceedings, so that is a possible route.
