Statement question.

I am sorry if my friend has already asked this (and I am sorry friend if I am interferring).
My friends dd is 5.5yo and has AS, she has recently moved to a much better school and because she applied for a statement while at the other school she has been turned down.
The jist being that the new school has much better experience of children with ASD and that they would need to asses how she is getting on there first. What would be the best way to go about appealing this decision?

Hopefully someone with the techical knowledge will come along soon.
I do know that if the school applied there is no right of appeal - if parent applied there is but the time to appeal in is very short (a matter of days not months if I remember correctly). Other than that you can re-apply after a minimum time (is it a year?) or if there is substantial new evidence ie from the new school or other professionals that her needs cannot be met without the support of a statement.

magso - DDs previous school submitted the application, but i do still have the right to appeal to SENDIST not sure if this varies with differant LEAs. According to my letter from the LEA i have 2 months to appeal, is this correct?

She has coped really well so far at her new school but she is still needing almost constant TA support.

Only last week her teacher told me that if she was to assess DDs level thingys she would not meet the expected minimum requirements for a child in reception, as she refuses to take part in most activaties.

Im so f*cking angry about it all, i just dont seem to be able to right for doing wrong.

Yes you are right you have a right of appeal through sendist (its the school that don't)but I can't find the timelimit (I had 6 weeks in my very unreliable mind)! (And it is 6 months not 12 between statement requests I looked it up) Fortunatly our statement request was not turned down but ds was 7 and really should have had it from nursery! If I had known then what I know now---( ds school kept withdrawing the request!) so I am very impressed you are appealing! I found the ace booklets helpful www.ace-ed.org.uk/advice/booklets/Assessments.html the other booklet getting the statement right is helpful once you get there too. They have a free text request service so perhaps they can send you the time limit?
There are knowledgable people ( and parents who have experience of sendist appeals) on here- but perhaps at work.

Would also suggest you contact IPSEA as they are very good at the whole minefield that can be the statementing process. SOS;SEN could also advise.

If the statement request that the school make gets turned down by the LEA (and in such cases they more often than not get turned down) the school themselves have no right of appeal. You as the parent only have a limited amount of time to appeal their crass decision.

It sounds as well like this application got turned down at one of your LEA's panel meetings. These LEA employed people do meet on a regular basis - I would endeavour to find out how often they meet and aim for that next panel meeting putting in more evidence to back up your case.

You have far more power than school would ever have when it comes to statement applications anyway.
