Mediation - Refusal to issue

Hi

I've got my date for mediation.

I'm wondering if there's anyone who's been through and can give me tips or advise?
And possibly explain the process of the call.

Refused to issue a plan. Reasons; can be met within local offer.

I know a lot say it's a delaying tactic but there's a year wait for tribunal and I'm wanting to give it a try.

During mediation you will get the chance to explain your PoV. You need to explain and show why it is necessary for special educational provision to be made via an EHCP. This is the legal test as set out in section 37(4) of the Children and Families Act 2014. Explain what special educational provision DS needs that can’t or won’t be provided within ordinarily available provision at state mainstream schools. Then reference your evidence to back your claims up.

If you haven’t already it is worth reading IPSEA and SOSSEN’s websites and the SENCOP.

Make sure the LA send someone who can make decisions. They often send someone without decision making authority even though they should be able to make decisions.
