Dla backdating

Does anyone have any experience of not being backdated their child’s dla enough?

for example, they received forms October but only backdated from December?

also anyone have any experience as to if you can get universal credit backdated too?

Did DC meet the time eligibility rules from October or only from December? For example, unless the special rules apply, was December 3 months from when the condition/disability started or was December when DC met the past presence test?

So he had it from birth may 2023
I got papers sent so I could fill in so it would be back dated to august (so 3 months after the diagnosis)
papers were sent and received early October by dla.
award given, but the backdated to December and not when it should have been or even backdated to October when they had the forms from.

What about the past presence test?

If you think DC meets all the criteria before Dec you should call them.

thanks for your reply, I did call them earlier and the guy said it’s just what the decision maker said and he can’t get any further information.
he says I need to go to mandatory reconsideration for the length of backdating

im pretty sure he passes the past pres test and my son also got it at his age for that period but I know rules do change.

Check the past presence rules and if you think DS is still eligible from earlier request a statement of reasons and do a MR.

If you owe child tax credits they may have taken some money off you.

we Don’t but thank you.
you’d think the decision maker would make a note as to why but unfortunately not so off to the mandatory reconsideration list we go 🙈

DLA backpay should not be used for a tax credit overpayment. It should not be sent to debt management for legacy debt.

we did and mr- went from a decline to HRC but only back dated to scan date not the date I called for the claim pack.

the gov website said it should be the day I called.
just wondering what to do now

Unless the disability was new and only met the eligibility criteria from the scan date you should call them.

Went to mandatory reconsideration. Sent a letter but still not heard back from them!!!
website says it should be from pack date. And even if not pack date I think it should be from the forms received date!!! Not 2 months after
