DLA Mandatory Reconsideration

Original Claim recieved by DLA on 6thJune23
Rejected 29thSeptember23
Sent off for mandatory reconsideration straight away and it was recieved by DLA on 23rdOctober23.

I rang this morning for an update as it has been with a decision maker since 6thNov so nearly 2 weeks and still no decision!
Has anyone around the same time frame as me heard back recently for mandatory reconsideration ? If so has anyone been successful and how long did you wait to hear about a decision ?
I have heard mandatory reconsiderations are more no’s than yes’s!
thanks x

So as of today (Monday 8th January) it’s 7 weeks since I did MR, I phoned Wednesday last week and was told that I had been allocated to a DM so I should apparently have a decision by the end of this week. I’m calling again Friday if I haven’t heard anything. I’m worried that it will be refused again then I have to make the decision of going to the independent tribunal or just making a fresh claim, that’ll be another 20 week wait (although it’s 39 weeks since I sent the first form off) and could still end up with the same outcome.

Hello, just wondering about doing an MR, when I called they gave me reasons on the phone that aren’t on the letter, is it quicker to call and then do it over the phone or send it on paper ? (The mr form)

Has anyone recently had a MR decision for DLA HRM my child is currently on HRC and LRM and im trying to get her entitled HRM under SMI criteria? They refused COC review based on some lines about communication in her EHCP which were taken out of context. She is non verbal 7 year old ASD and SPD who has failed PECs intervention twice all of which is well documented in reports sent. I sent my MR via phone around start of dec 2023 still waiting for the decision. Ive sent new evidence for MR which includes witness statement from a family member who is a mental health CNS, personal statement on why im appealing, another report from GP and statement from school SENCO.

MeggyIsmaili · 19/01/2024 09:55

I did mine on the phone as was stressed but i think you should send a statement on why you appealing stating why the decision is wrong. Also i was advised getting more evidence helps

Has anyone heard back about MR recently? My MR date 6/12, was told 3 weeks. 6 weeks Wednesday just gone and told not with DM yet 😓 28 weeks in total and counting 😬

MeggyIsmaili · 19/01/2024 10:26

DLA told me yesterday on that MR are taking up to 8 weeks Atm.

Kate831 · 19/01/2024 13:03

MeggyIsmaili · 19/01/2024 18:25

jellycat12 · 31/01/2024 17:08

Hi jumping on,

I've just found out today by phoning that my sons dla claim got rejected after waiting 21 weeks no letter yet they said it was sent 9 weeks ago, I've looked back through out original form and realised I've missed bits 🤦🏼‍♀️ is it worth doing the MR or a new form?

MeggyIsmaili · 31/01/2024 20:23

Definitely MR cause it will be quicker and you wont loss your back date if they award you. To be fair its hard to know what to send and say because dwp dont really give the best guidance on it.

jellycat12 · 31/01/2024 20:39

Okay Thankyou will wait to see what letter says just gutted

If you add new evidence you lose the back pay it tells you that on the form ? I also spoken to contact a family today who confirmed this ?

I did, a decision hasn’t been made as of yet unfortunately. Hopefully it won’t be too long now

Did you get a decision?

MeggyIsmaili · 01/02/2024 12:02

No not that im aware of hun she was saying here her claim was refused so not sure you would be able to send more evidence unless doing an MR or new claim i dont think they can reopen case becuase stuff missed but i knownif you start i knew claim any award would only be backdated to start of new claim and i guess would take longer

KatieO12 · 01/03/2024 00:09

Hello, I sent my MR off on 6th Feb, I haven’t been able to get through to find out if they have actually received it and haven’t had any confirmation. Did anyone get a letter/text to say that they have the MR?
Good luck all 🍀🤞🏻 xxx

Lulakate84 · 06/03/2024 10:26

No I was refused 26/01 an put through an MR over the phone, I then sent a letter with reasons why I disagreed with there points with more information on the 19/02. No letters or texts I called last week to check they had received everything which they had, I'm so nervous waiting it's awful.

KatieO12 · 06/03/2024 13:34

I managed to get through on Monday and they received on 13th Feb, the lady i spoke to said approx 8 week wait. The post is horrendous and i'm on tenderhooks about when i'm actually going to hear back.

Lulakate84 · 06/03/2024 16:08

Yep I completely agree, you know I still haven't even had a letter to confirm we got denied, if I hadn't of called up we would still be waiting.....it's insane x

Komahra · 07/03/2024 10:07

Hi,
It's a statistics showing how MR is successful? Can they lower the rate even if you send more evidence

This afternoon I received a call from the DLA asking for more information, they said that they would make a decision and I would hear in a few weeks by post......guessing that will be next year 🙄 the anxiety is real

newfriend05 · 24/03/2024 22:23

Hi did you call them again to see if they had made a decision? The post can take up to a month to get a letter from them

user1497874196 · 26/03/2024 19:44

I did a mandatory reconsideration over the phone 1/3 and told them I had evidence to send. I sent my sons 1st cahms report and a plan from his early help support worker who I had to request help from last year as his behaviour got so bad I could not cope anymore. Will they look at the MR before receiving the evidence or will they wait for it? I'm so nervous he will get a decline again. Mt scan date is 27/10 xx
