Mandatory Reconsideration

Hi has anyone been successful doing a Mandatory Reconsideration? I sent my sons forms off back in may today I got told he’s been refused I sent in HV report speech and language report the lady on the phone today Said I could appeal so I am doing so as I feel like my son has been let down I don’t even feel like the decision maker has even looked at the information I sent in as she stated on one of the reasons why he’s been refused is because children don’t see salt until there 3 !! My son has had 2 appointments already and sent his appointment letters off with his claim to support it so I’m so confused to why she’s saying that when i sent them salts input !
im wishing for the reasons to why that’s just one of them and they said there’s another one but the lady was being arsy on the phone so I felt to panicked to keep asking so I’ll just wait and see and then go from there but I’m dreading it my daughter has been in receipt of DLA since she was 17 months old she never had her diagnosis then she does now! And she’s been given high rate care until 2034! But yeah my son who’s so much worse than my daughter has been refused even my HV is shocked so she said she is gonna type up another key to support the appeal but I haven’t got any hope I’ve read up once they say no it’s very unlikely they will go against it ! X

I’m sorry to hear you didn’t get the outcome you wanted. You should definitely appeal and wait for the outcome letter in the post so you are able to counter argue each point, some awards get overturned at MR so you might not even need to appeal.

can I ask what evidence you provided alongside it?

@zoeybrooks45 hi yeah sure so I added speech and language appts and HV statement
the decision maker stated on one of the reasons to why she won’t award it is because children don’t get seen until they are 3 by salt but he’s been with them since he was 15 months old
and I clearly sent the salt letter in with his claim so they could see so for them to say that have they even looked at everything properly?
my daughter has been on DLA since she was 17 months and she has had her diagnosis now but she didn’t at the time I just think it all depends who looks at the Claims 🤦🏻‍♀️x

Has anyone asked for an MR and had the decision get worse?! My DD has been awarded High rate care but no mobility? I want to ask them to reconsider the mobility but whats the chance they will reduce the care element

Shauna2866 · 01/11/2023 22:05

@Onedayatatime13 my daughter only got Hugh rate care and no mobility she turned 3 in August they said I could apply for mobility part but they said no when I sent it in even though I know she definitely should receive mobility part but I was never going to appeal as I know they can be funny and give you less
my daughter got an award until she’s 14 I’ll apply when she turns 5 for the mobility but you can always give it a go and see what they say it’s just something I wasn’t comfortable doing just incase they said no and then give her less and less of a award time x
