DLA appeal

Hi.

The DWP apparently have responded to my appeal (over a month late) and have sent their
response in the post. During that time I have received 3 different dated letters from the appeal service telling me I need to respond to the DWP response. I have also had 2 texts. This morning I have had another text telling me to urgently respond to DWP response and send the tribunal service any extra evidence for it to be considered. I havent had anything from the DWP.

How long are others waited to receive their responses? I'm still getting all my post and particularly getting stuff from the appeals service but not DWP. It's worrying me as I dont want my son to be at a disadvantage. I'd love to know their reasons as all agencies are shocked he has been declined.

Any advice is appreciated.

Thank you

Have you contacted the appeals service?

Anono2022 · 04/12/2022 13:16

They aren't open of a weekend and aren't open outside my work hours

Could you call in your lunch or email them?

Anono2022 · 04/12/2022 14:58

I only get half hour so it's very difficult. I have emailled them a few times but I don't get a response.

I'm just worrying as I have nothing to respond to. But I'm getting all my other post

It may be too late now but I found when applying after I had to appeal that all they were actually concerned with was the amount of time needed for additional care needed. I didn’t realise this initially but once I calculated specific times needed for care roles and advised of this DLA was approved.

I hope you managed to get through to them and make them aware.

Ahhhh thank you. Im going to do a timeline. I've have the court pack now and they have followed the opinions of his old schools. I've proved it to be dishonest but all that was ignored. We have everything in place with MAA, consultants and therapists/agencies. It was all ignored, their reports and statements totally disregarded. Then someone who has never met my child but is in a medical profession said he has no needed.

I need to respond and I'm going to ask why all the evidence from OT, CAMHS, SALT, Paediatrician has been ignored. He even has his panel meeting date now. Now according to his old school there are NO TRAITS OF ASD. It is Mom who wants to believe he is. I'm absolutely fuming! But I will also include a time line of what I do. Thank you

I've had a response from dla for my appeal not yet had letter in post just text saying they have responded it states paperwork on way anything more to add send to the appeal address and bit of info on next steps ,,,, so does this mean dla still say no and want court to go ahead or could the letter still say they will award dla and stop action?

Anono2022 · 07/02/2023 18:54

@Watever in my experience yes. They have maintained their decision.

I've continued and am awaiting a hearing date. I've also sought representation for my local welfare rights
