Hello wondering if anyone has any advice or help if possible? We have had our draft ehcp in June which was very woolly, we made our comments and returned selecting a Special Educational setting. We have had next too know communication from our caseworker, emails are rarely responded too and we have had no further updates or information, where do wego from here? Is there anyone we can contact? Thank you for reading any advice would be great, i feel totally lost with the whole process.

Email the Director of Children’s Services informing them they are in breach of the statutory timescales, IPSEA have a model letter you can use. Tell them unless they finalise you will be forced to begin Judicial Review proceedings. If that doesn’t work contact SOSSEN for help with a pre-action letter.

Thank you so much for responding, i have done that today and started the complaints process, i have downloaded the model letter to edit, i have tried too get through to sossen today but had no luck so far, i will keep trying. How long should it take to get the answers back from Special schools usually? We haven't heard anything from our requested Educational settings, thank you.

I think it's 2 weeks for schools to go back to LA following receipts of the consult to say if they can meet needs.

The LA must finalise within 20 weeks. The school(s) should respond to a consultation within 15 days, but the LA cannot delay finalising because of a lack of response.

You don’t want to go via the LA’s formal complaints process now because it will take too long. You want to inform the LA they are in breach of the statutory timescales and are frustrating your right of appeal so if they don’t finalise ASAP you will begin JR proceedings, which if you go via the complaints process you won’t be able to do straight away as it will acknowledge there is an alternative remedy. Thank you for the replies and the advice, i really appreciate it, thank you for sending the link i'll look at that now. I feel like i am shouting through a glass box with this it all seems so unnecessarily complicated.
