My sons 14. He's been at same high school for 3 years. He has an EHCP as he has ASD (aspergers and ADHD).
He's been bullied at school by children for years. Now it appears 2 teachers are picking on him too and its seriously affecting his mental health.
He has started being Mute in class. When asked to talk or say 'here' for register hes either silent or whispers. When he whispers teachers give him detentions for 'being rude' and 'refusing to answer'.
Had a meeting with headmaster yesterday and pastoral school 'basically moaned about my sons rudeness and behaviour'. i took a good friend with me who is very pragmatic. they didnt like it at the school very much. headmaster claimed he knew nothing about my son's autism causing him to be mute. said he thought he was just being 'annoying'.
they said they would talk to teachers and make them aware.
But ...shouldnt they have been AWARE my son has ASD anyway!! isnt selected mutism 'a common thing'?
He has had months of hell. Being picked on. given detentions. being made to leave the classroom in front of everyone.
to top it all the straw that broke camels back was headmaster told my son as of sept he is not allowed to wear his covid mask anymore! my sons distraught as hes been hiding behind it throughout covid and claims he is unable to take it off in school not even for one second.
so heres the thing. he is now saying come sept he will not go to school if he cant wear a mask. headmaster says he cant wear one and will not make an exception. so what do we do? does that mean i have no choice but to pay for homeschooling? would i be able to force school to allow him to wear a mask?
Hes clever by the way. top in most classes. why should his last 2 years at school be ruined because of this.

Does DS’s EHCP accurately reflect DS’s needs and the support he requires? If so, the school must be aware of DS’s SM and how his ASD manifests itself. Teachers should know DS has an EHCP.

Telling DS off and punishing him for whispering/refusing to answer when he has SM is disability discrimination. Is DS receiving any support for his SM? If DS wants to wear a mask because he wants to hide behind a mask it probably isn’t helpful to encourage that long term. Some of the other punishments may also be disability discrimination but there isn’t enough information in your post to judge.

You don’t need to EHE. It sounds like you need to ask for an early review of the EHCP. If DS can’t attend school due to his SEN the LA must provide alternative provision and anything in section F of the EHCP.

Are the school dealing with the bullying?
