Is anyone able to assist please? I have tried to find the specific tenant rights on Google but clearly not looking in the right place. Long, sorry.
DS lives in a self-contained flat in a supported living house with 4 others. He is fairly independent, and attends a mainstream college with support, the other residents are a mixture but are mostly somewhat independent older women. Several months ago a new resident who needs 24hour care was moved in. Unfortunately the resident is very loud and spends a lot of the night screaming and shouting sadly. Everyone else can’t sleep and DS is unable to cope with the sensory overload, and has had to come and sleep at the family home up to three times a week. Obviously we understand why this is happening. This is in no way meant to demonise that resident.
My question is about DS’s rights as a tenant. If this were a usual flat rental he would be entitled to quiet enjoyment of his home. Does this extend to his situation? DS is forming a pattern of coming home when there is noise, which defeats the purpose of independent living, and I have concerns that the other resident’s needs are not being adequately met. I am speaking to the agency who run the home with little effect. I just don’t know exactly what his tenancy rights are. His rent is not funded by UC but his support is funded by county. Thanks.
