appeal dla decision

Hi my son has been awarded middle rate care and no mobility. My son has a awkard walk which causes him to fall over and has many cuts and bruises from this and stitches and also he needs care day and night from adhd and sensory issues which causes him to wake up. I think I should appeal but not sure. Anyone else been through this?

I would appeal yes.
My son (8) has just been awarded high rate care and low mobility. He has asd and does not sleep. Is high functioning really but can't for example get himself dressed as he gets frustrated, can't tolerate having hair washed, won't brush teeth, won't leave house without lots of input.
He has no mobility issues but he needs lots of supervision out of the house. I think this is why he was given a mobility element. I would definitely challenge it op.

Thank you they said as he is not on sleeping pills and at a sleep clinic and is normal to wake up 2 to 3 times a night for a child of that age. I said about the supervision too but again they said that was normal. I called the doctors and they are doing a letter to confirm his walking hours so hopefully that helps and think I will print something to compare a normal 4 year old sleeping to my sons. I will appeal as nothing really to lose am just cross about it as its affecting my work walking up that many times in the night.

I meant to confirm his waking hours. He also has an awkward walk and school confirmed this but think will get school to do a more detailed report as although he can walk he falls over around 4 times a hour so am just getting that looked into as well and he does a moves programme at school for his balance but it was not enough. I think they chance their arm the DLA

I think the age is the key factor here. I have read that people say that children don't get high awards until age 5+ and they use the argument like you said that most children don't sleep good at a young age. And the mobility thing will definitely be more likely after age 5, keep trying op.

You can't get low rate mobility until 5, and it is LRM that considers supervision. It is possible to get high rate mobility from 3, but from your posts it would be under the virtually unable to walk criteria, and I'm not sure what you have posted is enough - you would need to be lucky at tribunal.

Be aware if you appeal you could lose the middle rate care.

Thanks everyone he is 5 next month so maybe different then. No I don't think will get mobility in reality but I do think high rate care. Just hard in the middle of the night when takes an hour to settle back down and trying to work as well.
