Draft EHCP is a joke!

After a long battle I finally got the LA to draft a EHCP. But it's a joke! The Outcomes they have set for my daughter to achieve by age 14 (currently age 10) are pitiful. They are outcomes that were set for her in primary! (e.g., be able to name a few basic emotions).

Also, is it common for the draft EHCP to be emailed to the parent on Friday and the meeting to follow on Monday morning! This means I have been given two days to scrutinise the draft cannot contact SENDIASS for advice. Sad

This is from the Ipsea website 'Along with the draft EHC plan, the LA must give notice to the parent or young person that they have 15 days in which to:

make comments – ‘representations’ – about the draft EHC plan;request a meeting with the LA to discuss the draft;request that a particular school or other institution is named in the final EHC plan.

The LA are legally required to do this (under section 38 of the Children and Families Act 2014). If you are not happy with any aspect of the draft EHC plan, or the reports attached to it, you can suggest amendments you would like made.'

Thank you.

Why have they made a meeting 2 days after the draft plan? Why waste everyone's time? Confused Is this standard practice?

Agree with what Niffler said.

There is a lot of useful info on the IPSEA site.

www.ipsea.org.uk/what-to-do-when-you-receive-your-draft-ehc-plan

A model letter to respond to the draft:

www.ipsea.org.uk/responding-to-a-draft-ehc-plan-model-letter-3

EHCP Checklist:

Has the LA said what the purpose of the meeting on Monday is @PusheenLove?

Hi again! Also se the Special Needs Jungle website for EHC flowcharts. You are entitled to 15 days to review the document, seek advice, discuss and request changes etc. This is the law.

Thanks everyone.

All I know is the meeting tomorrow is called 'Draft Planning Meeting'. I'm not entirely sure what that means.

OK, I think this is a meeting to assemble all the evidence/ documents/ discuss the content of the plan. You should be taken step by step through this. Also provision should be discussed and your views documented. Following this a draft plan is drawn up and sent to you. You then have a 15 statutory period to comment.
That's my understanding. At my draft planning meeting for my son's plan there was the planning officer and the ed psych who carried out an assessment. Mine was a very collaborative process.

So I'm not expected to have done much prep for this initial meeting?

"Draft planning meeting" yet they have already sent the draft plan?Hmm

Sounds a bit back to front to me.

Just make it clear that you know you are legally entitled to 15 days to consider the draft plan.

Niffler75 · 28/03/2021 18:39

Yes it does seem a little back to front. Who will be at the meeting. I must admit I would be pretty furious at the lack of notice! 😕

PusheenLove · 29/03/2021 09:34

At the meeting: me, SENCO at current primary, SENCO at new secondary school, SEND officer, some other people from the LA that I don't recognise the names of. Meeting is in 30mins and I'm very nervous. Tried phoning the current SENCO for info but cannot get hold of her.

@PusheenLove will you let us know how it goes? x

It went quite well. The school SENCO was amazing! She suggested a lot of amendments and was a strong voice of reason against the LA. I'm looking forward to my copy of the draft plan which I will send to SENDIASS.

@PusheenLove Oh I am so pleased. Fantastic the SENCO has got your back! When you get it, go over it with a fine tooth comb and get that input from SENDIASS.
