Should we ask for an EHCP?

Hi everyone!! So my son has selective mutism and on the path way for an asd assessment. At school a teaching assistant sits with him as he will do no work independently. He is beind in most areas and especially struggles with the social and communication side of things. I do feel like the school are meeting his needs right now but as he moves up the years this may change. Do we apply for a EHCP now or would this be rejected?

It sounds as though you have a good case to argue for an EHCP. You have nothing to lose.

You can apply for an EHCNA yourself now. The threshold for a needs assessment is has or may have SEN, and may need SEN provision to be made via an EHCP. Any other test the LA applies is unlawful. If DS is receiving 1:1 and struggling academically, emotionally and socially he certainly meets the criteria.

The LA may refuse an assessment, they often do, but appeal. The majority of appeals are upheld.
