Local authority neglected my autistic son

Hi everyone,
I am a bite disappointed and confused and sad that the Local authority can neglect my child with autism in high needs and offer me an EHCP with 6 hours a year of 1-1 speech and language therapy (my child has no speech) and also tried to name a mainstream school for him and refused the special school i requested.
And in fact I know some parents their kids is talking and less complex autism and they have more provisions then my son if I keep quiet about it I know my son will never have a chance and will lost forever.anyone have any tips how to get the LA to accept the special school I request as he will get a 1_1 all the way please??

Focus on your DC, your comments about other DC aren't relevant. Just because a child with ASD has speech doesn't mean their needs are less complex.

Provision in the EHCP is taken from the assessments, what do DS' reports say? What do the reports say about the placement?

Why are the LA refusing to name your school preference? Unless the school you want is wholly independent (is it?) there are a limited number of reasons the LA can refuse. They are:
"*The setting is unsuitable for the age, ability, aptitude or special educational needs (“SEN”) of the child or young person; or

  • The attendance of the child or young person would be incompatible with the provision of efficient education for others; or
  • The attendance of the child or young person would be incompatible with the efficient use of resources."

1:1 isn't automatically given in SS, in fact it is less likely to be given than in MS.

Have you already received the finalised EHCP? If you have are you still within time to appeal? If you are, you should appeal.

Thanks 10brokengreenbottles am not focusing on other people's kids but clearly it seem unfair even the child's father was surprised , DC report say his needs are high it doesn't say anything about the placement as the diagnosis was done when he was 2.5 he is in nursery now and every other week I get to sign incident report to and every time either he was climbing or running either is a cut or bruise. so he needs someone with him all the time his EHCP was just finalized last week he no supervision at all times and the reason for not naming the special school was expensive,the special school agreed to take him
and special school I wanted they have a 1-1 ratio.

What do the assessment reports from the needs assessment state? Not the diagnosis report, the assessments carried out after you applied for an EHCP. It is these that inform the provision and placement.

If the reports don't state a certain provision it won't be included in the EHCP. For example, if the reports don't state full time 1:1 it won't be in the EHCP. Which is why it is important that the reports are detailed, specific and quantified. If the reports are vague the provision will be, too.

If the EHCP was only finalised last week you can appeal. Don't bother with mediation, just get the certificate and submit to SENDIST ASAP. LAs use mediation as a delaying tactic, if they are going to concede they will regardless of whether you partake in mediation or just get the certificate. Depending on your reports you may need independent EP, SALT and OT assessments.

Is the SS wholly independent? The LA are refusing to name your school preference based on "inefficient use of resources". What is the cost difference? What evidence do you have that DS needs SS and MS can't meet his needs?

Thanks again 10brokengreenbottles, tbh the report where done during lockdown it was by phone not observation it is vague reports ,he is in mainstream nursery and it is a waist of time they don't know how to deal with special need kids he is not supervised at all times that resulted in so many accidents , and is due to start reception in September with this EHCP is disaster and I no longer have the energy to fight with schools he has no language he hasn't got concentration poor eye contact he doesn't sit in order to learn you have to sit and pay attention, so am really getting depressed with all this and if I have the money I would keep him home and pay for his education,

If the reports are vague you are going to need your own doing to stand any chance of getting a detailed, specific and quantified EHCP with 1:1 naming what sounds like a NMSS or independent SS - quite possibly wholly independent.

When the reports were written you could have asked the LA to go back to the report writers to make them specific and quantified. However, now it would be best to focus on getting your own reports and going to tribunal.
