So I’ve posted on here a few times and got some good advice off most people. Now it’s really just a bit of a vent as I’m feeling a bit down and my family don’t really understand and just think it’s bad behaviour.
After having nothing but problems since starting yr 2, being put on a part time timetable after two days, being sent home numerous times, having to get her to school extra early to help her settle, she got officially excluded today.

I thought I’d be relieved to have paperwork to prove her needs aren’t being met but I just feel so sad for her and unsure where to turn. She’s back on Wednesday, although if I feel she’s having another morning like today I need to ring the school and keep her home, but now I’m just so scared for her future.

@emmapemma91 💐 I'm so sorry, it's really stressful.
Can you remind me what's going on for your daughter? Any diagnosis, EHCP etc?

She’s awaiting assessment from CYPS so no diagnosis yet although paediatrician and school strongly suspect it.
No EHCP as school won’t support it and think it’s too early due to her only starting in September, although I’ve applied myself and still waiting for decision.

She got put on a reduced timetable 2 days after starting the school. She’s been sent home twice without paperwork due to becoming aggressive. This time it’s an official exclusion until Wednesday.

So this so called “outstanding school" that has put your child on a P/T timetable and has now officially excluded her is still not supporting the application for an EHCNA? Hmm

You might like to point out to the HT this information in the official Exclusion Guidelines:

In particular on P6:

“The decision to exclude a pupil must be lawful, reasonable and fair. Schools have a statutory duty not to discriminate against pupils on the basis of protected characteristics, such as disability or race. Schools should give particular consideration to the fair treatment of pupils from groups who are vulnerable to exclusion.

Disruptive behaviour can be an indication of unmet needs. Where a school has concerns about a pupil’s behaviour, it should try to identify whether there are any causal factors and intervene early in order to reduce the need for a subsequent exclusion.”

I would put a complaint in to the Governing Body that the school is not fulfilling its duties under section 66 of the Children and Families Act 2014 – this is the duty to use their best endeavours to ensure that children with special needs receive provision to meet their needs.

Has the LA responded yet to your request for an EHCNA? They have a statutory duty to respond within 6 weeks.

Hi @emmapemma91 You've had some really good replies. Also take a look at the resources on Special Needs Jungle and Not Fine In School.
I had to complain, apply for EHNA myself and hold the LA to account.

Still no reply from LEA, it’s coming into the 5th week. Just had a email with some information after making a Subject Access Request so will forward that and the exclusion letter for LEA.

Ask the school to support your application for her ECHP. If they are suspending her then they should.

What was the reason for her suspension?

I'm so sorry you are both struggling.

She got suspended due to leaving the classroom, destroying property and throwing furniture 😔

We’ve also hit another stumbling block, as now apparently all her data from her previous school has went missing. They claim it was passed on to current school in line with Data Protection. Her current school claim they haven’t received any from them. Her previous school are the ones her recognised her needs and put her onto the SEN register so their information would have been very helpful!

Ask them how they are going to manage her behaviour when she goes back.

Well surely the previous school can still write something for you @emmapemma91 - they can't possibly have forgotten what she was like in such a short time.
