Help ..going to have to home ed

Dc has place in special school ,currently school refusing because he says the dc attending are not high functioning like him and lessons are noisy .( it’s not that simple ,but don’t want to bore everyone)
It’s a long story ,but school have not attempted to meet his needs .
So I’m left with no alternative but to home ed ,because LA won’t provide an alternative, while school are saying they can meet need.
I’ve argued back and forth ,school are fucking useless ,but I’m stuck .
So my question is ,if I home ed for a year ,can I re apply and ask for a different school in a year or 2 years if we manage ok ,or will he be expected to go back to this school till he’s 16

Hi Im left with similar problem (currently home educating). I suppose your son has EHCP?

How old is your son? If he is refusing to attend then I would call for an emergency review of the EHCP which will give you leave to appeal to SENDIST. Then I'd invest in independent assessments and let them inform you of the sort of placement your child needs. In the meantime I would ask for a referral to CAMHS because refusal is probably down to anxiety.

Camhs have been seeing him 3 years
School say they can meet need
He’s refusing to go ,as he says the children are nothing like him there
School also did not put anything in place from ehcp
But. While school say they want him ,to lea ,but don’t make any changes ,

It’s a nightmare,and it will be easier to home ed
We didn’t get a choice of school either ,just given this one ,my dc is very bright and does coding ,best I can hope for is a personal budget ,but I’d say I’ve. 1% chance of getting that

None of them seem accept autism is a huge spectrum,and just because the children might have the same diagnosis does not mean they should be all lumped together regardless Of ability

It’s the Council’s job to ensure provision is in place, not the school’s. If he is missing out on provision in his plan, complain to the Council - it may well help them realise the placement isn’t suitable.

Good. Keep going all the way to the Ombudsman if necessary, you will hopefully start to see results. The advice about requesting a review above is really good too.

So you write to the LA regarding failure to make the provision in the EHCP template here If your child isn't attending then obviously the school aren't meeting need because he isn't there. Don't go down the Home Ed route. The LA will wash their hands of you.

As others have said ask for an early AR and complain about failure to secure the provision in accordance with Section 42 of the Children & Families Act 2014.
