AttilaTheMeerkat · 04/10/2007 12:52

Glad to read also it went your way!.

Well done you, am so glad that SENDIST were able to bring this LEA to book. No less than they deserve.

bonkerz · 04/10/2007 12:58

SENDIST seem to have really understood our concerns and have used words like unimpressed and that the LEA seem unconcerned despite all evidence! Am totally overjoyed especially as Ed Pshych has really been got at for his lack of help and support!!!

Brilliant Bonkerz !Well done!! Just as well your DS has such a strong mum! Can uncross my fingers now!

bonkerz · 04/10/2007 17:38

thansk guys. Went into school earlier to let head know and she actually said that she was pleased and had expected it! She said although no decision about statement will be made for a while she is going to try and implement up to 20 hours 1:1 (she needs to look at figures etc) She said if she does this it will help to minimise the impact of the statement as basically the statement will just say she needs to provide what she already is IYKWIM. She has also booked for an anger management person to come in to work with DS on an intensive course!
Had pead again today and he did another assessment, He feels there may be communication problem as DS couldnt do what he asked without being shown and also low level dyspraxia as shoe laces, knife and fork handling etc is significantly delayed!

daisy5678 · 05/10/2007 17:24

It all sounds great - well done - I know how hard it was to get my son's Statement, but I am cynical about this bit: "She said although no decision about statement will be made for a while she is going to try and implement up to 20 hours 1:1 (she needs to look at figures etc) She said if she does this it will help to minimise the impact of the statement as basically the statement will just say she needs to provide what she already is IYKWIM"

Lovely that the school is going to put stuff in place to support, BUT what if the LEA did their assessment and decided NOT to issue a statement (rare, but it does happen) and then you had to go back to appeal...the LEA would say that the school can meet needs from own resources, because look, they already are putting x, y and z in place, so in law there is no need for a statement if school can meet needs from own resources. Then you don't get a ststement and the school could withdraw the support as it wouldn;t be legally 'yours'.

So sorry to put a downer on things, but I've seen this happen and seen it on the SENDIST website in past cases too.

Just wanted to make you aware - I'm v. cynical over LEA game playing these days.

bonkerz · 05/10/2007 17:29

thanks teachermum, im very cynical too! I have realised you dont get anything without fighting! Strangely though i have just ahd a call from the head who has informed me DS had a massive blow out today and she is seriously concerned as it is the first time she has seen it and in her 30 years teaching she hasnt seen anything like DS!!! Head is set on ensureing DS gets help as she is really worried! I think that the head will push the LEA into a statement TBH as she recognises the trouble we have had so far! Will stay on top of it though!!

Fabulous! So very pleased for you.

dustystar · 05/10/2007 17:32

Teachermum has a point actually bonkerz

My mum is a SENCO and this has happened to children in her school because she puts so much effort into supporting them.

She tells the LEA that the school cannot continue that level of support without funding but they refuse the statement anyway.

dustystar · 05/10/2007 17:41

Just spoken to Mum and she agrees with teachermum.

In the short term their idea is the best for ds but if he improves too much with the support the LEA may well say he doesn't need a statement. So longterm it may well be better if the school don't give him too much support too soon.

flyingmum · 05/10/2007 18:12

Congratulations. You must be thrilled. Much virtual champagne glass raising to you.

dustystar · 05/10/2007 18:16

Just reread your last post - the head at ds old school said exactly the same thing to me about him.

Its great that they are onside but please remember that whatever the school says if the LEA judge that the school is managing without needing extra funding they may turn the statement down. It has happened to my Mum on more than one occasion.

bonkerz · 05/10/2007 21:26

thanks dusty. will have a chat next week with head and put across those concerns. Maybe she should hold off giving support! Peadiatrician actually told me to try and delay LEA doing assessment till DS has been and had assessment at CAHMS! He said DS would get more from a statement once diagnosis had been made.

Really pleased for you. I hope you get a satisfactory Statement. They know now you mean business.
