EHCP & moving down a year

My son has an EHCP (he has DLD) and we are asking for him to be moved down an academic year. He's in a language unit, year 2, doing really well, but is behind academically. We know that he will need to transition back to mainstream in the next couple of years so are asking for him to be moved down a year group (he's August born) because that feels like the right fit for him, peer group wise. School agrees, but council are saying there is no guarantee this will continue when he moves to secondary. I know that's right for mainstream pupils who start reception a year late, but is that also true for a child with an ehcp? If we get it written in, surely the secondary school would have to comply?

If it's put into his ehcp you would be able to enforce it. I would imagine that the local authority would be reluctant to include it but that's the only way it would be enforceable otherwise you are relying on the school/la agreeing.

Thanks Biggreen87. That’s what I thought, but the LA are implying it can’t be written into the EHCP. Not sure if they are being deliberately misleading or if the individual just hasn’t seen it done before.
