20 weeks is up- still no EHCP!!!!

So I spoke to our councils SEND planning coordinator for an update on DD’s EHCP as I hadn’t heard anything since the assessment phase, and she happily told me the draft was nearly finished and she was sending it out the following week. I was obviously thrilled that it’s been excepted and have been eagerly waiting for it to arrive...

That was 3 weeks ago and still no draft. I sent an email last Friday morning asking when I could expect it (I’m writing this on Monday evening) and have had no response. Today is exactly 20 weeks. What on Earth do I do now?! I thought it was the law that they had to abide by the 20 week rule??

Any help appreciated

It is the law but local authorities are a law u to themselves.Hmm

Ipsea have advice on this. Look for their model letter 10.

Hi - I would suggest you phone up and ask for a copy of their complaints procedure as you're not happy over their lack of response. I did this when I had a delay and kept getting got a similar response over the initial application to request an EHCP Assessment for my DD.

Everything suddenly started working and I got an apology for the delay!

On week 52 and just had Ed psych assessment I hate to tell you I'm in Norfolk BTW

Threaten judicial review for failure to stick to the EHCP timescales. Usually the threat alone works, but if not you will need a pre action letter.
