EHCP process

Hi I have been waiting to hear about if my son is been given a ehcp for him to go to a school. I know I should receive one with a ehcp offer and I have 15 days to add or remove things. I have received a letter from the speech and language therapy at the top of the letter it says advice for ehcp. A copy has been sent to me and to the ehcp is this them asking what to include when they offer me a ehcp plan or is this the plan I have 15 days to reply back to. I've not been able to get hold of the senco at school for a week and half and now they are on holiday for a week so I'm stuck who to ask what this letter is. I hope somone can help me thanks

Not 100% where you are in the process, but, from the "I have 15 days to reply back" I'm going to assume you have received the 'Draft' EHCP. At this point, they say if they don't hear back from you then it will become 'Final' in 15 days.

The letter from the SaLT is a bit confusing.
If I am right about this being the end of the process, then it is a bit odd that you have had this now. Has it been sent with the draft EHCP ? So SENAR are just letting you have copies of all the 'advice' they have received ? So have you also had the 'advice' from Nursery and medical people too ?
OR
Has the SaLT sent the report now, and copied you in ? In which case it doesn't sound as if they would have considered that advice when drawing up the EHCP ?

The important thing to do is to get back to SENAR and say to them that you are uncertain, and you don't want it finalised until you are clear. Tell them you have been trying to get hold of the SENCO and not been able to.

Google SENIASS and the name of your local authority and ask them for help in the mean time.

Have you had a planning meeting to discuss the content of the EHCP? I assume the assessment has already taken place?

The EHCP will state that it’s a draft EHCP and this is most likely the SALT’s recommendations for the assessment and plan. They would send a copy of their report to you as well as the LA, as would any educational psychologist etc. If you are unsure then do contact your LA so you don’t accidentally miss the deadline.

I don't think I have had a draft the only thing I have had is. A letter of advice ehcp from spech and language therapy sent to me and the board as it says at the bottom. I wasn't sure if that was the draft as I don't k ow what the ech draft looks like and no I have not recived a meeting with them either. Yes think I will give them a call tomorrow just to be safe. As we are at 21 weeks this week and I've not evan had anything saying we have been approved for a ech but I've not had anything saying they are not doing one. Thanks very much for your replys. I've had the phycologist report for months that was sent to them when we first sent paperwork in and from the school and cahms and the speach and language was all sent with the original request.

Steph just on related note, we have sent stuff with original request - all reports etc. LA are 'deciding whether to assess' and ask us who we want them to approach at this point. Isn't it really just us and school and ed psych, maybe SALT? I mean the other NHS teams are not really going to advise them one way or another on whether to actually assess? Or are they? Confused.

If you mean where I said cahms for the NHS then yes our cahms team are involved with the ehc request and will be involved with the new school aswell as it's the reason he goes to cahms on why he needs the ehc in the first place. If I have understood you correctly. I phoned the ehc today and they said that letter was not the draft as they are still waiting for people to send them more reports and we have a few more weeks to wait till decision but atleast I know now and can sort of relax for a few weeks. Thanks for the help very much appreciated

How long is it since you asked for an EHC assessment? They are supposed to let you know within 16 weeks from when they received the request whether they are going to issue an EHCP or not.

It's 21 weeks this week from sending and they sent me a letter the 20th of March it was to state they have received all of the stuff. And they will contact who they needed to and would contact me if they needed more information wich they have not.Yes I was told originally by my senco lady it would take 20 weeks all together from sending to then getting told a yes or no but they did not care about that when I phoned and said we have untill mid July. I think i will go back to the senco lady at ex school and see if she can get them to hurry up as mid July for a draft is way to long since my son is no longer in school and the 6 weeks hols are coming up end of July wich means would have to wait till September for evan a meeting with the school to see if they are suitable

We actualy sent them the request the 14th of March from the school senco with all the back up paperwork from other departments and if I rember right I actualy sent them a parent ech request before that with just the standerd stuff a few weeks before we sent the one from the school but not sure of the date the senco sent that.

The clock doesn't start ticking from when you put it in the post, it starts from when they pick it up out the in tray to start working on it.

However, you can go and look round whatever school it is you are hoping for now - you don't need to wait for a school to be named. Indeed, that would really be too late.
Go and look at possible options and get all your ducks in a row ready for when they ask you your preference.

I already have two schools in mind that I've done some research on just not visitd yet as they will not consider without a ehcp I did not think they would let me look and speak to them before we had a answer

No, it starts ticking from when the LA receives it - see Regulation 4(1)(a) of the Special Educational Needs and Disability Regulations 2014. And "receives" is definitely when it arrives at the LA's office, not when they claim the case officer picked it up for the first time.
