EHCP assessment concerns

LA agreed to assess. We have our private professionals at the ready. We have concerns about who the LA have requested their evidence from. The LA medical officer is the same paed who has already given our 13 yr old a lengthy dismissive ASD Assessment recently, citing 'traits' and yet stating these weren't enough to explain my child's year long difficulty in attending school. When this paed turned out to be our LA’s medical officer who sits on panels against parents and indeed initially sat on the panel that refused to assess, I thought ‘how can this NHS paed's assessments be independent and honest when they also work for the LA?’ Now a few months later and this paed's supposed to examine my child again for LA / EHCP? Only no doubt to sit on panel again to refuse to issue, right? Please tell me I have some chance to query this? This paed has got FII insinuation in every breath. Thank god we already have previous robust NHS 'significant DCD' diagnosis! But what do I do about this awful all powerful paed?

I fear you have to live with it. If you try to avoid him it will only fuel perceptions that the whole thing is FII.

I'm not concerned about FII because I'm not complaining about the others the La have chosen to provide evidence, just the one who's previously assessed my child then went on to sit on LAs panel. One legal told me that this is conflict of interest. The legality of this is what I'm here to gather comments on.

Update: I was right. I've had the panel
Members taken off the list of so called 'experts' giving evidence for the LA assessment. Be warned. If you don't ask, you don't get.
