just got the case statement from sendist.
In it supplied by my lovely LEA are:
A yearly school report from the home tuition service, not signed by anyone and also we havent been sent a copy.

Details of an alleged email and phonecalls to the headteacher of the special school we wanted DS to attend where he says that DS cant go as there is no nhs dx and that there are no places, this is not true as both us and our psych who does work at the special school checked beforehand.

Our words completely twisted and apparantly at one meeting i stood up and shouted "This isnt happening" well i might have thought of doing that but i certainly didnt.
There are no conversations that DH had with our LEA reps in any meetings recorded and their star witness is the Educational Psychologist who asessed dd without speaking to us and concluding that she didnt need statementing, so she,s going to the tribunal next week and she,s never even met DS, so whats she going to say?
The headteacher of the primary school the LEA want ds to go to has written a letter saying she is concerned about the hours/provision they are proposing as she doesnt think its enough given Ds,s complex needs, she,s going as well.

Oh and the headteacher came to see Ds yesterday from the special school but he said DS is too high functioning and he would be more isolated at his school as there is no peer group for him.
But the 2nd school say he does meet their criteria.

Confused? cos i know i am, i think i will need some valium to get through the tribunal next week.
They really really get me annoyed with their lies [angry}

Perhaps you ought to take a tpae recorder in next time and explain that it is to avoid inconsistancies.

it would be priceless, they would start shifting about in their seats and looking very sternly at me!!!!!

i have emailed my lea today asking them to send me a piece of missing evidence from their statement.
the reply i got at 9am this morning was that my lea lady was "Dealing with it" what that means i can only guess.
Missing evidence, made up telephone calls,star witnesses who have never met Ds, a headteacher who says not enough hours in the statement......................
oooh its going to be good next week.........
im so glad ive got an ipsea rep.

oh and guess what else, a yearly report from the PRU unit for 2006/2007 where the tutors say DS would be better suited to a mainstream environment, but none of them have signed it!!!!!!

its all adding up for after cos we are going to sue for failure to educate him for 2 years.

Hopefully SENDIST will see through that shower of an LEA and the IPSEA rep will wipe the floor with them as well. Are this LEA really going to show up at Tribunal with this so called evidence?.

i dont honestly know.
i thought that they would have dropped out by now but cos one of the special schools has said no to DS as he is too HF i think thats spurred them on.
DH is convinced they will drop out beforehand.
our psych has been laughing his socks off at their evidence and i quote "Its the same old shite rehashed over and over again to try to make a good story"

my ipsea rep is going to phone me over the weekend when she gets a good look at the papers but the lady who has been supporting me all along on the phone has told me its pathetic.

i think we are being used as an example to other parents, the whole of our borough and the next one knows about the tribunal cos dd is in the next borough and we,ve had so many well wishes from nhs workers in the next authority.

im ready for them,ill just sit back and watch their case collapse and then sue them

i have just heard back from lea, they say that as a local authority they cannot release emails to a 3rd party but she has typed the transcript for me and she says i can present it as late evidence if i want.

but this email was regarding a placement for ds, surely i am entitled to see this as part of the data protection act?

is this normal? if so i will have to drop it wont i.

i emailed the executive director of the council and sent the correspondence from the SEN team.
he replied (bearing in mind this is the big big cheese)

No ms or from Mr thats quite informal isnt it?
so i thought well ive nothing to lose so i emailed him back and "advised" him all about DS how they have failed to educate him for 2 years - he only receives 2 hours per week, how we have documents to say that because ds wasnt in school that "regular school attendance would drive SEN participation" and that we considered his council has discriminated against our son being in school through no fault of his own due to him having a severe mental health breakdown.

that was yesterday afternoon and i havent received a reply back so i dont know if anything will happen.

oh and i got a letter yesterday from School B to say that Ds fits their admission criteria that there are places available in his year but unless the lea give permission for them to asesss him there isnt much they can do oh and the headteacher very kindly put that there is a boy already there who,s sn needs are not disimilar to my ds and he is coping wonderfully at his school.

psych says thats an offer of a place.

4 days to go and im on countdown now.
