When do you apply for an EHCP?

Hi, DS is yr 3 and really struggling at school. He is awaiting diagnosis of dyspraxia (he has seen an ed psych/OT/ and physio who all believe he has this, and reported as such). He may also have some set of SPD or other processing disorder, not sure yet.
We have been CAF'd and TAF'd, IEP's for the last 2 yrs. it feel like we are just getting by.
I have waited over 6 months to see a paed and still await an appt, having originally been refused to be seen 18months prior.
CAMHs were no help, an assessment with a nurse who said he had not got autism or ADHD but would benefit from a sensory assessment and never arranged, discharged in fact.
So I feel like we are in limbo, treading water. My DS currently has regular OT and play therapy as his anxiety levels are high, most days he doesn't want to go to school as he has a fear of getting hurt due to him falling over regularly.
Any advice would be welcomed but want to know if EHCP is the way forward, when and how?
Thanks

Hi - The law says children with SEN are entitled to a EHCP from the age of 2 and parents are able to apply for one.

I don't have any advice about applying as I am just about to start the process myself. My son is 3 years also and has ASD. I have heard they can be difficult to obtain so I am preparing for it to be a fight Confused

You can apply yourself to your LA, but the "best" time is when you have a decent evidence base. Obviously if they decide to assess they will gather their own, but you will need to convince them in the first place! Have a look at www.ipsea.org.uk for advice and template letters etc.

Thank you, I have gathered a fair amount of evi but I think I need the paediatrician one as well yet, hopefully I won't have to wait much longer, it feels like an eternity!
