DLA mandatory reconsideration refused

Hi all,

I have my MR come through and as expected the original decision has been upheld. My concern is that I don’t believe the DM has reviewed any of the new evidence that I sent in with the MR. It’s been completely overlooked and the reasons for refusing DLA for my son are almost identical to the previous reasons despite the new evidence. However, there are quite a few contradictions along the way.

I’m aware the next stage is to appeal and go to tribunal but does anyone think it would be worthwhile ringing the DWP and asking to speak to a case manager and voicing my concerns that I don’t feel the MR was done fairly and that I don’t feel the new paperwork sent in was considered?

I’ve been in a similar situation- but for ESA for my young adult son. MR was refused- and my reasons for reconsideration seemingly ignored. I did speak to a ‘decision maker’ but was basically told I’d have to appeal.

So I put in the appeal (with no further evidence from MR). Once the DWP got the appeal I got a phone call to say DS would be awarded ESA - on the same evidence the DWP had had at MR. I had the distinct impression it was the first time it had been read properly...

So, although there’s no harm in ringing, I’d get on with putting the appeal in - with the same evidence as before. I think the DWP caved in on my DS’s claim when they had to write a case response to the Tribunal - and they couldn’t ignore my evidence - or justify the inconsistencies in their earlier decisions.

Thank you for your reply. I’m pleased the decision was made in your sons favour.

I’ve just spoke with a case manager and he assured me that all my evidence had been considered and advised me to appeal. He did say if anymore clinical evidence comes through in the meantime then to send it to the tribunal and to the DWP and he would review my claim.

Its such a struggle to get new evidence when the waiting times to see a professional are ridiculously long. I really was hoping it wouldn’t go to tribunal but I’ll keep fighting :)

Hi there iv been waiting over 3 weeks for my decision on my mandatory reconsideration. I did and reports god knows if that will help
