Ehcp not being followed

My DS was given an ehcp in July after a few months of negotiations between me and la on the terms. Unfortunately school do not appear to be following the terms of this and the provisions are not being provided. When I met with Senco and teacher they advised that it was in place and being followed but when I speak to DS he does not appear to be having the OT provision at all. He has this with another child in the class and his mum has also raised concerns. The school seem to say my DS probably doesn't realise he is getting the input. It doesn't help that DS has lots of salt issues too so is hard to get much info out of him. He is also meant to get extra time in tests and given longer time to answer questions but again this doesn't happen. Each week he is tested on a Tuesday for Mental maths with the whole class with no extra time and each week get 2 out of 20. I am not sure what to do next.

You need a meeting with senco. Ask for a quantified provision map and a copy of his IEP. They will tell you they don't need to provide one. Yes they do. You need to know his short term outcomes and how and when and by who they will be achieved. Also request this in writing (email rather than phone call) to make sure you have a paper trail. I would also find out the name of your LA caseworker and consider copying them into emails too. They are funding the provision that the school is choosing not to provide, which is the provision outlined and specified in the EHCP. The LA is responsible for ensuring the needs are met and if school won't take notice of you, don't delay. I did and time was wasted my DS can't get back. I learnt the hard way and these days it's polite but hardball. Not the person I like being but the one I've had to become.
